Dear valued clients, colleagues and friends,
Starting from 1 January 2025, providers of Internet messaging services and social media services with 8 million or more users in Malaysia will be required to obtain an applications service provider class licence under the Communications and Multimedia Act 1998 to offer their services within Malaysia.
“Internet messaging service” refers to an applications service which utilises Internet access service that enables a user to communicate any form of messages with another user, while “social media service” means an applications service which utilises Internet access service that enables two or more users to create, upload, share, disseminate or modify content.
In connection with the upcoming regulatory changes, the Malaysian Communications and Multimedia Commission (“MCMC”) is now holding a public consultation on the draft Code of Conduct (Best Practice) for Internet Messaging Service Providers and Social Media Service Providers (“Draft Code”), which is accessible here.
The Draft Code sets out best practices for licensed providers of Internet messaging and social media services, with the aim of addressing harmful content online and outlining other relevant conduct requirements to be observed.
Interested parties may provide their feedback and comments on the Draft Code to the MCMC by 5:00 p.m., 5 November 2024. Contact details and further information can be found at here.
