In light of recent developments on Section 340 of the National Land Code, we held a forum entitled “Issues on Fraud and Indefeasibility of Title under the National Land Code” at the AIAC where participants delved into a discussion on the recent decisions, including CIMB v AmBank (2017) Limputan Simfoni v Pembangunan Orkid Desa (2018), T. Sivam v PBB(2018), See Leong Chye v UOB (2019) with our Head of Dispute Resolution Practice Group, Datin Jeyanthini Kannaperan and the legal implications arising from such cases.
Further scenarios of fraud in the context of Section 340 were considered and discussed by our Dispute Resolution Partner, Lai Wai Fong, and our Senior Associate, Koo Yin Soon. Tan Yin Lu, our Senior Associate closed up the afternoon with recommendations and steps to be taken in prevention of fraud together with useful insights provided by the Head of the Real Estate Practice Group, Sar Sau Yee. The event was attended by more than 80 of our clients and we would like to record our thanks to our clients for their continuous support.
